Dr Stoney testified his pleas for help were ignored and he quit as Medical Director of SunBridge Newport Beach, due to Sun Healthcare's blatant disregard for human life. He'd socialized with the CEO, Richard K Matros, and was told the "Calvert" case was already compromised in November, 2003. Furthermore, that Debbie Calvert, myself, would be better off taking pix of Mr Matros at "Laker's games" and sharing them with Dr Matros, his wife, rather than suing -to get further with Matros in retaliation for his blatant harm done to my mother. A clue Matros had already engaged my corrupt attorney at the time, Daniel Leipold, to commit legal malpractice, so that Matros couldn't lose his job! Matros' willful misconduct was easy to prove. And apparently his infidelities were as well!

Even the Dept of Justice, via Claude Vanderwold, prevented justice in this case! Was it for a price?

Why did the District Attorney in Humboldt County, Calfornia, Paul Gallegos, who prosecuted a case against Skilled Healthcare for under staffing, rendering a jury award of over $677 Million, refer criminal charges to the Orange County District Attorney for prosecution? What is the status of those charges and who is under investigation for violating a state injunction?

Why did the former Administrator of SunBridge Newport, Susan Zanca, receive $90,000 in pay for her work performed there for the months May through September, 2003? Was there a $50,000 bonus for killing patients? It simply doesn't make sense Sun would pay her that large amount unless they had some reason to secure her testimony in two lawsuits they knew would be filed for wrongful deaths.

Why didn't The Orange County Register and Los Angeles Times print the fact we reported deaths in Sun Healthcare's SunBridge Newport on Superior Avenue in 2003? I also personally called and wrote to both the Dept of Justice via the Calif State Attorney General's office, Claude Vanderwold and Dept of Health, Jackie Lincer, and told them patients were "dropping like flies" from Sun's neglect, abuse, the CEO's willful misconduct, yet they did nothing until the 5th patient I knew died, Richard Laga, in December, 2003. It was too late for my mother, Evelyn Calvert, who was already in an acute care hospital with MRSA from Sun.

I believe there is widespread corruption in this industry or at least amongst the CEO of Sun Healthcare. My mother's physician, Dr Stoney, told me to fear Sun's CEO for being the whistleblower, that they'd "plant a gun or drugs in your car" if I continue to pursue truth behind the wrongful death of my mother. I was also threatened by my former late corrupt attorney Daniel Leipold in mediation that they'd harm me. I was witness to 5 deaths they caused, I reported them, yet they were never held accountable. Some who died didn't have family to puruse litigation.

When I attempted to hire another attorney, Keith Wisbaum in July, 2006, to have the settlement set aside he wrongfully charged me $2,500, spoke with Daniel Leipold then refused to file what was needed in court, jutt too busy he said. Months later he passed a message to me from Rick Matros after Matros lost an attempt at a restraining order that I could call him at anytime if I needed anything. They feared me. It was what I knew as a witness that scared them.

Put all together my case is a perfect example of how big corporation politics work. Ask Julie Campbell, employee of Sun, just how this happened. I do not believe she'd lie for the former CEO of Sun Healthcare, Richard K Matros any longer.

Richard Laga

In 2003 Richard Laga complained to me the weekend of the 4th of July that Susan Zanca, the Administrator hadn't found a wound care nurse for him as promised before the holiday weekend. He suffered with a sore on his foot that turned to gangrene and was hospitalized the following week at Fountain Valley Regional Hospital. I visited him when I learned of the seriousness of the gangrene. He asked me to get my attorney to visit him. And I did, Daniel Leipold, indeed did visit Mr. Laga and I confirmed this with Mr. Leipold and Mr. Laga, who told me he had a good case against Sun Healthcare Group Inc. We both knew the Dept of Health visited Mr. Laga and was the one to tell him, as she cried at his bedside, that he wasn't just losing his foot, he'd lose his life. Her visit is well documented by the Dept of Health, as I've read the record an Mr. Leipold also had that record. Mr. Laga later fell into a coma and died from this gangrene in December, 2003. I asked Mr. Leipold who said he never got his signature so couldn't sue. Dan Leipold fully knew that Mr. Laga's wound caused his death and that Sun was responsible.

What kind of man would apologise for harming a patient in his care then cheat the family out of wrongful death? Is Richard K Matros capable of being a true sociopath? His past actions tell a story that shareholders need to know. This man hurt many people then showed a callous disregard for their pain. Why? Only a true sociopath would behave in this manner, my opinion.

Medicare / Medi-Cal Lien for nursing home costs

I asked my fromer attorney, Daniel Leipold, to calculate the amount of the liens by the state and federal government that my mother incurred while living in the nursing homes from August, 2002 through July, 2004. That figure should have been paid back from the wrongful death proceeds Sun paid us. I was told that number was around $91,000, yet Leipold didn't pay it down with his $17,000. That was fraud. It was also fraud that he didn't negotiate at least this amount when he advised we settle with Sun for just $55,000. It was criminal for him to pass threats to me in mediation for the CEO of Sun, Richard K. Matros, in Jun, 2006.

The government needs to investigate why this attorney and possibly others didn't repay nursing home costs when the nursing homes were found in violation of state and federal laws.

Attempted Eviction Causes CEO Anger?

An advocate for elder abuse and the neighboring resident at SunBridge Newport, a Patient's daughter-in-law, was forced to attend a Dept of Health hearing for eviction by the CEO of Sun, Rick Matros. He lost that hearing. Afterwards retaliation was almost unbearable. Under staffing, broken equipment, regional managers sent to threaten patient's families (Fernando Rodriquez, Julie Campbell and others).

This fight continued until even my attorney was mis-led by the CEO and committed malpractice. I sued him and he died just 2 weeks later, 2 weeks after Matros attempted a restraining order against me and lost. The Judge said "She proved Rick Matros killed her mother, certainly she can state it. Freedom of Speech, Protected Speech and Peaceful Protest. She did a whole lot less than I would have done if I were her. She should file a slapp back lawsuit against him for malicious prosecution. A slap is not harm. You've just introduced evidence that she doesn't even know what he looks like, how can I ask her to avoid someone she doesn't even know?". My attorney said "Certainly you're not going to ask her to carry around a family picture of the man who killed her MOTHER?".

My mother's physician and Sun Healthcare's Medical Director of the Sunbridge Newport Rehab facility, Dr L Scott Stoney, met with Richard Matros at a Lakers game where Matros asked if the families were really mad at him. Dr Stoney said yes, and the Calvert family would be suing for harm done when the blood pressure monitor broke in October and caused her to have a large stroke. He warned Matros that the families were savvy and he couldn't tell them black was blue and they'd go away, they found out about the Califonia state injunction and were pursuing criminal charges against him. Dr Stoney gave a message for myself, Debbie Calvert, "tell her she'd be better off taking pix of Matros and his high priced prostitutes at the Lakers games rather than suing Sun in the court system". Dr Stoney said Matros promised he could even
introduce him to the owner of the Laker's, Jerry Buss!

I realize now this was a message from Dr Stoney, our star witness, that Sun Healthcare's CEO had my attorney in his pockets and it didn't matter if I sued. I sued that former attorney for malpractice and he died 2 weeks later. He dropped wrongful death without consulting any medical professional nor myself. He ignored my numerous emails that Dr Stoney was glad we were suing and willing to testify. It was obviously a sham representation and I have the evidence to prove it.

This shows how the CEO of Sun Heatlhcare operated in a criminal fashion to avoid prosecution.

Asset search and blog causes heartache

An asset search was performed on Richard K Matros by attorneys suing for malpractice involving his activities as CEO of Sun Healthcare Group Inc in 2008, where it was found he and his wife had put assets into LLCs they once jointly owned. I blogged this fact and it was faxed to me recently when I asked for reconsideration of the wrongful death lawsuit I was cheated out of by Rick Matros.

The behavior of this CEO needs investigating, since these appear to be criminal acts.

CANHR sues Sun Healthcare, settles out of court

CANHR, a nonprofit consumer advocacy organization filed a lawsuit charging Sun with unlawful business practices, unfair and fraudulent business practices, and false advertising (California Advocates for Nursing Home Reform v. Sun Healthcare Group Inc. 2003). The lawsuit alleged that Sunbridge facilities in California were more than 1 million hours on aggregate below the state's 3.2 nursing hprd direct care requirement, which resulted in a savings of more than $15 million by not meeting the staffing standard in 2000. The litigation was settled out of court in 2004 and the settlement results were not made public.

Julie Campbell, former girlfriend of ex-CEO Richard K Matros, and employee of Sun Healthcare aka SunBridge, apologized for harm done to my mother by Sunbridge Newport in October, 2003, claiming Rick Matros himself was sorry. For me to call her anytime day or night if there were ever any more concerns at their facility and they really wanted to make amends with me. She met me most every weekend for six weeks from mid October, 2003 through November, 2003, then Sun transferred their license to another healthcare provider. This was after they caused four deaths I knew of: Stella Carter, Betty Harness, Richard Laga and the man in Rm 2B in October 2003. All from broken equipment and lack of staffing while committed to a Calif state injunction.

Yet they escaped punishment both criminally and civilly.

I now have quesitons for Julie Campbell, because in my wrongful death lawsuit I was cheated out of a jury trial where she would have been asked to explain her behavior.

Who asked her to apologize to me for Rick Matros in October of 2003?
What did she know he knew about harm done to my mother?
Who asked Fernando Rodriguez to leave the building at Sunbridge Newport after he was fired?
What did she know they thought he was doing to my mother?
Did she discuss the broken blood pressure monitor with the Administrator Gail Conser or anyone else?
Why does Julie believe she was never called to testify in my wrongful death lawsuit agaisnt Sun?
Is she aware my orginal attorney, Daniel Leipold, committed a serious malpractice against me by dropping wrongful death without consulting any medical professional?

If I could get these answers I'd feel a whole lot better about my mother's death. If I could get compensation for her wrongful death being that Sun's employees were sent to apologize to me, I'd also feel a whole lot better.

Why was there a telephone message in my mother's medical record that Dr Stoney called and to withhold her blood pressure meds unless needed? Why was the b/p monitor soonafter found to be broken? Why did my mother have a stroke exactly at this same time that I was witness to? And why wasn't Sun punished for these criminal acts? Dr Stoney swears he'd never have left that phone message and I believe him.

Questions for Fernando Rodriguez:

Who told you to tell me "if you don't like that we understaff then take your mom and leave" in July, 2003? Witnesses are Georgianna Dickson, Susan Zanca, Edgar Morales, the Director of Nursing at the time, et al.

Why did you appear in the SunBridge Newport facility in October, 2003, after you were fired? Did you do anything to harm my mother in retaliation for your firing?

Why did you tell the nurse Patty Bowman that Sun didn't care if they understaffed, they'd only pay fines ten cents on the dollar since they were coming out of bankruptcy and it amounted to a few hundred dollars, while they were saving hundreds of thousands in nursing wages. They were well aware how to profit: under staff and you made that clear. Did Richard Matros tell you this?

Were you aware Julie Campbell was sent to talk to me about harm done to my m other in October, 2003? What do you know about that?

Questions for Edgar Morales: Do you recall a meeting where Fernando Rodriguez, Regional Manager for SunBridge, told me that they didn't care if they under staffed, if I didn't like it I could take my mother and leave, he was telling me for the third time today?
Do you recall meeting me in a local restaurant a few years ago and telling me you were willing to testify against Sun because of all the stress it caused you in 2003? You provided your telephone number to me to give to my attorney, yet he never called you to get your testimony, correct? That's because he was corrupt and I had to eventually sue him for malpractice -he died and I sued his estate, settling out of court in 2008. He prevented a jury trial that would have destroyed the CEO of Sun Healthcare Group Inc, by exposing his willful misconduct in violating a California state injunction by under staffing and killing 5 patients I knew of alone.

Questions for Elizabeth Van Dyke: Do you recall in October, 2003 stating "well we killed that one" when Betty Harness returned from Hoag with so much fecal impaction it was even in her lungs?

Jury Trial for wrongful death?

Do you think the CEO of a large nursing home chain, Sun Healthcare Group Inc, obviously powerful, would allow a wrongful death case to go to a jury trial in his hometown where he's profited enough to buy three Oceanfront homes, and when he knew we could prove his willful misconduct by violating a state injunction, including slumlord conditions? Why did my fomer late attorney so obviously commit malpractice by not discussing my mother's death with any medical professional before he dropped wrongful death from the lawsuit? Then why did I win that malpractice case against him? Why didn't the Dept of Justice's Bureau of Medi-Cal Fraud and Elder Abuse punish Sun for violating their 2001 Calif State Injunction not to understaff or have known broken equipment?

CORRUPTION!

Sworn statements from family members and physicians confirm a persistent lack of basic care amounting to elder abuse. Patients died from Sun's lack of staffing and broken equipment, two in October, 2003 alone. Medical supplies weren't replenished and family members bought them for their loved ones when the facility ran out. Families were retaliated against for filing formal complaints with the Dept of Health and Dept of Justice, Sun's management even attempted to set visiting hours for which the Dept of Justice told the Dept of Health to fine them if they barred families from seeing their loved ones any time they wish, which is federal law. Per Joseph Fendrick, Dept of Justice.

A Californa state injunction dated 2001 existed against Sun Healthcare yet it is a matter of record that while these complants were filed in writting with the Dept of Justice, they instead pursued the hispanic employees of an Escondido Sun facility for failing to administer eye drops to a patient, later dropping all charges. The Dept of Justice NEVER prosecuted Sun for the 5 deaths they caused from 2002-2004: Stella Carter; Richard Laga, Betty Harness, Evelyn Calvert and the man in Rm 2B October, 2003. There were undoubtedly more, as I worked full time and knew about these patients in the off hours. The DOJ settled with Sun for $2.5 Million in Sept of 2005 for violating it's injunction in the state without considering any of the Sunbridge Newport deaths, why?

Even the Director of Nursing, ElizabethVan Dyke, said "Well, we killed that one", when Betty Harness was brought back from Hoag Hospital with a word from the good doctors there that there was nothing else to do for the poor woman, Sun had killed her from lack of staffing to track bowel movements. It was even in her lungs. Van Dyke ordered milk of magnesia for all patients who couldn't talk. Yet the Medical Director, Dr Stoney said, "Not my patients".

Richard Laga didn't get the wound care nurse he begged for before the July 4th weekend in 2003 from Administrator Susan Zanca, yet the Dept of Health never punished her and she is still working as an Administrator.

OSHPD and more

Don Morey, legal rep for OSHPD, says this and other field reports are missing from their records when I requested the copy of their file in 2010. They were purged from the public records. Why?
This looks like fraud to me. Sun's top officers were facing a possible firing over their handling of this facility in Newport Beach so it was in their best interest to bury these records!

This field report states "the need and urgency was discussed this date ~NO exceptions!" The HVAC system had been condemned by OSHPD on May 15, 2003. And never replaced for over 2 years. Sun sold this facility November 30, 2003, after killing 5 patients, so as to divest themselves from this liability.

The California Dept of Health, via Jackie Lincer, shut down this facility in December, 2003, not allowing my mother to return after a month long stay at a local acute care hospital, Hoag. She also refused any new admittances for six months until staff could be properly trained, due to these deaths. I have documents confirming this.

Does the Dept of Health even communicate with OSHPD? When there is a state injunction against Sun Healthcare why wasn't this facility held to a higher standard of care and this equipment immediately required to have been replaced in instead of allowing it to kill my mother, Evelyn Calvert? Sounds like corruption to me.

Sun Healthcare Group Inc admitted fraud in my wrongful death lawsuit mediation, stating they admitted to under staffing most every day she resided in their facility from August 1, 2002 until Decmber 11, 2003. This was in violation of an existing 2001 Calif state injunction yet the Dept of Justice turned a blind eye. I was thretened by my corrupt attorney for the CEO that they were also punishing me for writting too many complaining letters and deducting $20,000 from our settlement. After mediation I refused to sign confidential disclosures after being coerced into signing by a corrupt attorney. The CEO of Sun, Rick Matros, threatened me if I pursued the case to a jury trial I'd be "harmed". And that I wasn't getting the keys to his Bentley. I sued my attorney who passed on those threats for malpractice and he died 2 weeks after learning I'd retained Andres & Andres to sue him. I won that case against his estate in 2008. Daniel Leipold was his name, and I believe he was a stooge for Sun Healthcare. Another attorney I paid to legally help me, Keith Wiesbaum, was also on Sun's side giving me the message not to sue Leipold and Matros was a dangeros man.
